Eklecco Newco LLC, which is affiliated with Syracuse-based Pyramid Companies, said it has been battling for years to convert 250,000 square feet of unused space in the West Nyack mall into new retail stores, lohud.com reported.
The town, which had wanted Eklecco to close down several flood-prone roads at the site, got it to agree to the convenant in 1996 -- after construction of the multi-million-dollar mall was well under way, the lohud.com report said.
The lawsuit, filed Tuesday in U.S. District Court, is seeking millions in damages, the lohud.com report said.
The town told lohud.com that one, Eklecco had agreed that any plans to expand be put up for public vote, and two, it intends to defend itself in court with vigor.
